Privacy Policy

Review how we collect, use, share, and protect information through our website and the FieldMast mobile application.

[Company Name, e.g., TCG AI] ("we," "us," or "our") is committed to protecting your privacy. This policy explains how we collect, use, and disclose personal information through our website and the FieldMast mobile application.

We have appointed a Privacy Officer to oversee our compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA).

We collect information you provide directly and information collected automatically:

Account Data: Name, email address, and professional credentials.

Field Data (FieldMast): Geolocation (GPS), site photos, and time-stamped activity logs.

Technical Data: IP address, device type, and operating system version.

AI Processing Data: Data inputs provided for analysis by our AI services.

We collect your data for the following specific purposes:

To provide and maintain the FieldMast app services.

To provide data science and AI-driven insights via TCG AI.

To comply with safety and regulatory requirements in the field.

[Add specific purpose, e.g., "To generate automated reports for project management."]

By using our services, you consent to the collection of data as outlined. For sensitive data (like real-time location or biometric data), we will seek express consent (a clear "opt-in" action) within the app.

You may withdraw consent at any time, though this may limit your ability to use certain features.

We do not sell your personal information. We may share data with:

Service Providers: Cloud hosting (e.g., AWS/Google Cloud) and AI infrastructure partners.

Legal Requirements: When required by Ontario or Federal law.

Data Sovereignty Note: We disclose if your data is stored or processed outside of Canada.

As a Data Science and AI company, we use automated systems to process information. We ensure that:

AI models are used to [explain usage, e.g., "optimize field routes" or "identify data patterns"].

Users have the right to request information on how an automated decision was made.

We protect your data using industry-standard measures, including:

Encryption: Data is encrypted at rest and in transit (TLS 1.3).

Access Control: Strict MFA (Multi-Factor Authentication) for administrative access.

Retention: We only keep data for as long as necessary for the purposes identified in Section 3.

Terms of Use

These terms govern your access to the service, define user responsibilities, and explain the commercial and legal framework around the platform.

Since SaaS is a service, you are not selling the software; you are granting a limited, non-exclusive, non-transferable license to access it.

For FieldMast: Explicitly state that the license is for the user's internal business operations only and prohibits reverse-engineering your algorithms.

In 2026, "best efforts" is not enough for B2B. You should specify:

Uptime Guarantee: (e.g., 99.9% uptime).

Maintenance Windows: When the app might be down for updates (usually 2:00 AM - 4:00 AM EST).

Remedy: If you fail to meet uptime, the remedy is typically a service credit (e.g., 5% off next month), not a cash refund.

This is critical for a company like TCG AI.

Customer Data: State clearly that the customer owns the data they upload (site photos, logs).

Usage Data: State that you own the de-identified, aggregated data used to improve your AI models and app performance.

Input/Output: Define who owns the AI-generated reports or insights.

Ontario law allows you to cap your financial risk. A standard 2026 clause often:

Caps damages at the amount the customer paid in the previous 12 months.

Excludes "consequential damages" (e.g., if the app goes down and they lose a contract, you are not responsible for that lost profit).

What happens when the relationship ends?

Notice Period: (e.g., 30 days notice to cancel).

The "Sunset" Period: Give them 30 days to export their data after cancellation before you delete it permanently from your servers.

By clicking "I Agree" or by accessing the Services, you enter into a legally binding contract with [Your Company Name]. If you are using the Services on behalf of a company (e.g., a field service firm), you represent that you have the authority to bind that entity.

We grant you a non-exclusive, revocable right to access the [FieldMast/TCG AI] platform. We reserve the right to modify features to improve the service, provided that such modifications do not materially diminish the core functionality.

You are responsible for:

Maintaining the confidentiality of your login credentials.

Ensuring all data uploaded complies with Ontario privacy laws (PIPEDA/PHIPA).

Preventing unauthorized access to the Service.

Fees are billed [Monthly/Annually] in advance. Late payments may result in service suspension. All fees are in [CAD/USD] and are non-refundable unless otherwise stated.

We own all rights, title, and interest in the software, including all AI models, UI designs, and trade secrets. You grant us a license to host and process your data solely to provide the Service to you.

You agree to indemnify [Your Company Name] against any third-party claims arising from your breach of these terms or your misuse of the Service.

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be settled in the courts of [Toronto/Mississauga], Ontario.
